Wenn aber, wie jetzt geschehen, das Bundesverfassungsgericht in Karlsruhe feststellt, dass es neben den Möglichkeiten "weiblich" und "männlich" noch eine dritte Option geben muss, um das Persönlichkeitsrecht zu wahren, eine Diskriminierung eines anderen Geschlechts verhindert werden soll und den Gesetzgeber auffordert, bis Ende 2018 einen dritten Geschlechtseintrag zu schaffen, dann hat diese Maßnahme nicht nur für die individuelle Identität eine herausragende Bedeutung, sondern wirkt sich auch auf viele Bereiche des öffentlichen Lebens aus.
- Geklagt hatte der 27-jährige Leipziger Vanja. Auf einem veröffentlichen Foto eindeutig als MANN erkennbar. Im Geburtenregister steht 'weiblich'. Er möchte aber die Kennzeichnung 'inter/divers'. Quasi nicht als Mann oder Frau gelten. Warum dann der Vollbart, der ihn geschlechtsspezifisch als Mann erkennbar macht ? -
Da im deutschen Grundgesetz Artikel 3 (3) ausdrücklich darauf verwiesen wird, dass 'niemand wegen seines Geschlechts......benachteiligt oder bevorzugt werden darf', so betrifft das natürlich auch das 'dritte Geschlecht', sobald der Gesetzgeber dieses offiziell verkündet.
Es spielt daher keine Rolle, ob es nun 'nur' eine Person betrifft oder tausende intersexuelle Menschen (Schätzungen ca. 80.000). Wenn es z.B. um Bestimmungen im sportlichen Bereich geht, dann muss /müsste umgehend (?) nachgebessert werden, um Diskriminierugen zu vermeiden.
Natürlich gäbe es auch eine andere Möglichkeit für diese Personen, wenn sie an sportlichen Wettkämpfen teilnehmen möchten. Sie müssten sich für eine der beiden Geschlechtsklassen entscheiden und registrieren lassen. Eigentlich undenkbar, oder ?
